كِتَاب الْفَرَائِضِ
The Book of Al-Farad (The Laws of Inheritance)
بَابُ: {يَسْتَفْتُونَكَ قُلِ اللَّهُ يُفْتِيكُمْ فِي الْكَلاَلَةِ إِنِ امْرُؤٌ هَلَكَ لَيْسَ لَهُ وَلَدٌ وَلَهُ أُخْتٌ فَلَهَا نِصْفُ مَا تَرَكَ وَهُوَ يَرِثُهَا إِنْ لَمْ يَكُنْ لَهَا وَلَدٌ فَإِنْ كَانَتَا اثْنَتَيْنِ فَلَهُمَا الثُّلُثَانِ مِمَّا تَرَكَ وَإِنْ كَانُوا إِخْوَةً رِجَالاً وَنِسَاءً فَلِلذَّكَرِ مِثْلُ حَظِّ الأُنْثَيَيْنِ يُبَيِّنُ اللَّهُ لَكُمْ أَنْ تَضِلُّوا وَاللَّهُ بِكُلِّ شَيْءٍ عَلِيمٌ}:
Chapter. (The Statement of Allah:)“They ask you for a legal verdict. Say; ‘Allah directs (thus) about Al-Kalalah (those who leave neither decendants nor ascendants as heirs). If it is a man that dies, leaving a sister, but no child, she shall have half the inheritance. If (such a deceased was) a woman, who left no child, her brother takes her inheritance. If there are two sisters, they shall have two-thirds of the inheritance; if there are brothers and sisters, then the male will have twice the share of the female.’ (Thus) dose Allah makes clear to you (His Law), lest you go astray. And Allah is the All-Knower of everything." (V.4:176)
Hadith Number: 6744
حدثنا عبيد الله بن موسى، عن إسرائيل، عن ابي إسحاق، عن البراء رضي الله عنه، قال:" آخر آية نزلت خاتمة سورة النساء يستفتونك قل الله يفتيكم في الكلالة سورة النساء آية 176".
Hum se Ubaidullah bin Musa ne bayan kiya , in se Israeel ne , in se Abu Ishaq ne , in se Bara razi Allahu anhu ne bayan kiya ke aakhri aayat (meras ki) Surah Nisa ke aakhir ki aayitein nazil huien «yastaftoonaka qulil-laahu yufteekum fil-kalaalati» ke ”Aap se fatwa poochte hain , keh dijiye ke Allah Ta'ala tumhein kalaala ke baare mein fatwa deta hai .“
