كِتَاب الْوَصَايَا
The Book of Wasaya (Wills and Testaments)
بَابُ إِذَا قَالَ دَارِي صَدَقَةٌ لِلَّهِ وَلَمْ يُبَيِّنْ لِلْفُقَرَاءِ أَوْ غَيْرِهِمْ. فَهُوَ جَائِزٌ، وَيَضَعُهَا فِي الأَقْرَبِينَ أَوْ حَيْثُ أَرَادَ:
(I4) Chapter. When someone says,“My house is Sadaqa (i.e., gift of charit) for Allah’s sake," and does not specify whether it is for the poor or for some other people, then the Sadaqa is valid and he can give it to his relatives or whomever he wishes.
Hadith Number: Q2756-2
قال النبي صلى الله عليه وسلم لابي طلحة حين قال احب اموالي إلي بيرحاء، وإنها صدقة لله، فاجاز النبي صلى الله عليه وسلم ذلك. وقال بعضهم لا يجوز حتى يبين لمن والاول اصح.
Jab Abu Talhah (Radi Allahu Anhu) ne kaha ke mere amwal mein mujhe sab se zyada pasandida Bir-ha ka bagh hai aur wo Allah ke raste mein sadqa hai to Nabi Kareem (Sallallahu Alaihi Wasallam) ne ise jaiz qarar diya tha (halankey unhon ne koi tayeun nahi ki thi ke wo ye kise dein ge) lekin baaz log (Shafi'iyah) ne kaha ke jab tak ye na bayan kar de ke sadqa kis liye hai, jaiz nahi hoga aur pehla qaul zyada sahih hai
